The $500 Fraud Prevention & Detection fee applies to H-1B and L-1 petitions on initial approval or when changing employers. Not required for extensions with the same employer.
Applies when: (1) Initial or change-of-employer case; (2) 50+ U.S. employees; and (3) more than 50% in H-1B or L-1 status. Amount: $4,000 (H-1B) or $4,500 (L-1).
If exempt, ACWIA ($1,500 for 26+ employees; $750 for ≤25) does not apply. Typical exemptions: institutions of higher education; nonprofit entities related/affiliated to higher education; nonprofit or governmental research organizations. If unsure, leave unchecked.

The surcharge applies only to petitions filed at or after 12:01 a.m. Eastern Daylight Time on Sep 21, 2025.
If the petition requests consular notification, port of entry notification, or pre-flight inspection, the $100,000 surcharge applies when filed on/after the cutoff.
If USCIS later determines ineligibility for the change/amendment/extension or the beneficiary departs the U.S. before adjudication, the $100,000 payment applies per USCIS instructions.
Expedites processing for a guaranteed timeframe (e.g., 15 days for Form I-129 classifications eligible for premium processing).
